Terms and Conditions

1. Who we are and what IKU LOBI OCHA is

IKU LOBI OCHA ("we", "the Platform") is an online (SaaS) suite of tools for TikTok LIVE creators: AI-powered video editing, viral clip generation, motion graphics, overlays for OBS/TikTok LIVE Studio, battle scoreboards, an AI copilot/consultant, sticker-creation tools and, for agencies, a multi-creator management dashboard.

IKU LOBI OCHA is an independent product. We are not affiliated with, sponsored by, or endorsed by TikTok or ByteDance Ltd. "TikTok" and "TikTok LIVE" are trademarks of their respective owners and are mentioned solely to describe the compatibility of our tools.

By creating an account or using the Platform, you accept these Terms and Conditions in full. If you do not agree, you must not use the service.

2. Who can use the service

You must be at least 16 years old to create an account. If you use the Platform on behalf of a company or agency, you represent that you have the authority to accept these Terms on its behalf.

You are responsible for keeping your password confidential and for all activity that occurs under your account. Notify us immediately of any unauthorized use.

3. Plans, subscriptions and billing

We offer a Free plan with periodically renewed AI credits, and one or more paid Premium plans with more credits and additional features. Prices, included credits and conditions for each plan are shown on the Platform before you subscribe.

Free trial

When a plan includes a free trial period, this is clearly indicated before subscribing. Unless you cancel before the trial ends, the subscription will activate automatically and the first charge at the chosen plan's price will be applied.

Auto-renewal and cancellation

Paid subscriptions renew automatically at the end of each billing period (monthly, unless another period is stated) until cancelled. You may cancel at any time from "My Account" inside the Platform; cancellation stops the next renewal but does not automatically refund the period already started (see our Refund and Returns Policy).

Payment method and taxes

Charges are processed through external payment providers (Stripe and/or PayPal, depending on which you have configured). We do not store your full card details. Prices may include or exclude VAT/taxes depending on your country of residence and whether you are a business or individual customer; the exact breakdown appears on each automatically generated invoice, available in your account.

4. AI credits

Certain features (AI video editing, clip generation, image generation, motion graphics, chat with AI agents) consume "credits" allocated according to your plan. Unused credits in a given period are not redeemable for cash unless expressly stated otherwise.

If an AI generation job fails due to a system error, the credits spent on that job are automatically refunded to your account. This does not apply when the result was generated successfully but did not meet your expectations of quality or style.

5. Referral / affiliate program

You can obtain a personal referral link or code from your account. When someone signs up using your link and subscribes to a paid plan, you may earn a commission according to the percentage and conditions in effect at the time (visible in your referral dashboard), which we may adjust going forward.

Accumulated earnings are shown in your account as a pending balance. You may request payout of your accumulated balance once you reach the minimum threshold shown on the Platform; the payout is processed through whichever method is available at the time (for example, PayPal or a Stripe Connect transfer once that method is active), within a reasonable time after the request.

We reserve the right to void commissions generated fraudulently (self-referrals, fake accounts, abuse of the system) and to suspend access to the program in such cases.

6. Creator Marketplace

Once this feature is active, some users will be able to publish and sell their own digital content (animated stickers, overlays and similar assets) to other users on the Platform. By listing an item, you represent that you own the necessary rights to that content or hold a sufficient license to distribute it, and you grant buyers a usage license under the terms you define when listing it.

IKU LOBI OCHA acts as the technology intermediary for the Marketplace and retains a commission on each sale; the percentage is shown before you list an item and may change over time (changes do not apply retroactively to sales already completed). The remaining amount is added to your seller balance and can be requested for payout following the same procedure as referral earnings.

We may remove any listing that infringes third-party rights, contains inappropriate material, or breaches these Terms, and may suspend a seller's account in serious or repeated cases.

7. Your content

You retain ownership of the videos, images, text and other materials you upload ("Your Content"). You grant us a limited, non-exclusive license, only for as long as needed to process it (for example, sending it to AI providers to generate the output you requested, or temporarily storing it so you can download it).

You are responsible for holding the necessary rights over everything you upload and for ensuring its use does not infringe third-party rights or applicable law.

8. Prohibited uses

We may suspend or close accounts that breach these prohibited uses, with or without prior notice depending on severity.

9. Third-party services

The Platform relies on external providers: payment gateways (Stripe, PayPal), AI processing (for example, Google Gemini models), media storage (Cloudinary), server infrastructure (Render), and real-time TikTok LIVE data through specialized providers (for example, EulerStream). We do not control or guarantee the continuous availability of these third-party services and are not responsible for outages, changes or shutdowns that depend on them.

10. Warranties and limitation of liability

The Platform is provided "as is" and "as available". We do not guarantee the service will be error-free at all times, nor that AI-generated content will always be perfect or free of inaccuracies.

To the extent permitted by law, our total liability to you for any claim related to the service is limited to the amount you paid for your subscription in the previous 12 months. We are not liable for indirect damages, lost profits, or data loss arising from use or inability to use the service, except where applicable law does not allow such limitation (for example, willful misconduct or gross negligence).

11. Account suspension and termination

You may close your account at any time from "My Account". We may suspend or close accounts that breach these Terms, with prior notice unless the severity of the case requires immediate action (for example, fraud or illegal content).

12. Changes to these Terms

We may update these Terms when we roll out new features (such as the Marketplace or automated referral payouts) or to reflect legal changes. We will post the last-updated date at the top of this page; if the change is material, we will notify you by email or via a notice inside the Platform.

13. Governing law and jurisdiction

These Terms are governed by Spanish law. For any dispute that cannot be resolved amicably, and without prejudice to the rights that consumer protection rules grant to users acting as consumers in their country of residence within the European Union, the parties submit to the competent courts under those rules.
